Terms of Service

By accessing our website, requesting a proposal, approving a quote, paying an invoice, signing an agreement, or using our services, you agree to these Terms of Service.

If a separate written agreement is signed between you and Assanj Web Agency, that agreement will control where it directly conflicts with these Terms.

Assanj Web Agency provides digital services including website development, SEO services, CRM integrations, call tracking systems, lead generation systems, website maintenance, automation setup, and Google Business Profile optimization.

The exact scope, deliverables, pricing, timeline, and support level for each engagement will be defined in the applicable proposal, invoice, statement of work, written message, or service agreement.

Clients must provide accurate business information, approvals, login access, brand assets, photos, policies, service details, domain access, hosting access, CRM details, and other required content or materials on time.

Delays in providing required assets, feedback, credentials, or approvals may delay project timelines. Clients are responsible for ensuring that provided content, claims, images, trademarks, and business information are lawful and accurate.

Project deposits, setup fees, milestone payments, monthly retainers, and maintenance plans must be paid according to the invoice or agreement terms. Monthly retainers are billed in advance unless otherwise agreed in writing.

We may use Stripe, PayPal, bank transfer, or other approved payment methods. Late or failed payments may result in paused work, delayed delivery, restricted support, or suspension of ongoing services.

Deposits, setup fees, discovery work, strategy work, onboarding work, and custom implementation fees are non-refundable once work begins.

Refund eligibility for any remaining project balance is determined based on the stage of work completed, resources allocated, third-party costs incurred, and terms stated in the applicable agreement or invoice. Completed work, delivered assets, and active monthly services are not refundable unless required by law.

Project timelines are estimates unless expressly stated as guaranteed in a written agreement. Timelines depend on client responsiveness, scope complexity, content availability, third-party approvals, and technical dependencies.

New requests, revisions beyond scope, delayed feedback, missing assets, platform issues, or changes in direction may extend timelines and may require additional fees.

After full payment, clients receive ownership of final custom website content, designs, and deliverables created specifically for them, except for third-party assets, licensed software, stock media, platform code, templates, plugins, frameworks, reusable internal tools, and pre-existing agency materials.

Assanj Web Agency may display completed work in portfolios, case studies, marketing materials, and sales presentations unless a written confidentiality restriction is agreed before project launch.

To the maximum extent permitted by law, Assanj Web Agency is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of our website or services.

Our total liability for any claim related to services is limited to the amount paid by the client for the specific service giving rise to the claim during the three months before the claim arose.

Our services may involve third-party platforms such as hosting providers, domain registrars, Stripe, PayPal, Google Analytics, Google Business Profile, CRM systems, call tracking tools, automation platforms, plugins, APIs, email providers, and advertising platforms.

We are not liable for third-party outages, pricing changes, policy changes, account suspensions, data loss, platform limitations, API changes, algorithm changes, or service interruptions caused by third-party providers.

Hosting, maintenance, backups, updates, security monitoring, and support are provided only when included in the agreed service package or active maintenance plan.

If a client manages their own hosting, domains, plugins, DNS, email, CRM, or platform accounts, the client remains responsible for maintaining those systems and paying all related third-party fees.

SEO services are designed to improve technical structure, content quality, relevance, local visibility, and search performance over time. Search engine rankings, traffic levels, lead volume, or revenue results are not guaranteed.

SEO outcomes depend on many factors outside our control, including competition, algorithm changes, market demand, website history, client reviews, content quality, location, budget, and third-party platform behavior.

Either party may terminate services according to the cancellation terms in the applicable agreement, proposal, invoice, or written plan. Outstanding invoices and fees for completed work remain payable after termination.

We may suspend or terminate services for non-payment, abuse, unlawful activity, failure to provide required access, repeated delays, or breach of these Terms.

These Terms are governed by the laws applicable to Assanj Web Agency's principal place of business, unless a separate written agreement states otherwise.

For international clients, both parties agree to first attempt to resolve disputes through good-faith communication before pursuing formal remedies.
